Welcome to Smarters Academy!

These Terms of Use (“Terms”) govern your access and use of the Smarters Academy website, mobile application, and other online services (collectively, the “Services”). Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Services. You may not access or use the Services if you are located in a country or territory that is subject to a U.S. embargo or that has been designated by the U.S. government as a “terrorist supporting” country.

3. User Accounts

You may be required to create a user account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to notify Smarters Academy immediately of any unauthorized use of your account or any other breach of security.

4. User Content

The Services may allow you to submit, share, or post content (“User Content”). You grant Smarters Academy a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content in any media and for any purpose. You retain all ownership rights to your User Content.

5. Prohibited Activities

You are prohibited from using the Services for any illegal or unauthorized purpose. You agree not to:

• Violate any applicable local, state, national, or international law or regulation.
• Infringe the rights of any third party, including intellectual property rights.
• Tamper with or disrupt the Services.
• Use the Services for any commercial purpose without the express written consent of Smarters Academy.
• Collect or store personal information about other users without their consent.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Upload or transmit any viruses, worms, or other malicious code.
• Use the Services in any way that is harmful, offensive, or discriminatory.

6. Intellectual Property

The Services and all content included on the Services, such as text, graphics, logos, images, and software, are the property of Smarters Academy or its licensors and are protected by copyright and other intellectual property laws. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part, without the prior written consent of Smarters Academy.

7. Termination

Smarters Academy may terminate your access to the Services, in its sole discretion, at any time and without notice. Smarters Academy may also remove any User Content that it deems, in its sole discretion, to be offensive, harmful, or otherwise inappropriate.

8. Disclaimer

The Services are provided on an “as is” and “as available” basis. Smarters Academy makes no representations or warranties of any kind, express or implied, as to the operation of the Services, the information, content, materials, or products included on the Services. Smarters Academy does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.

9. Limitation of Liability

Smarters Academy will not be liable for any damages of any kind arising from the use of the Services, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

10. Indemnification

You agree to indemnify and hold harmless Smarters Academy, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, expenses, liabilities, and damages (including attorneys’ fees) arising from or relating to your use of the Services or your violation of these Terms.

11. Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms will be resolved exclusively by the courts of the State of California.

12. Entire Agreement

These Terms constitute the entire agreement between you and Smarters Academy with respect to your use of the Services.
